Some dude crashed into the back of my car when coming out of a car park. I got his details (name, address, phone) and he is comprehensively insured, but I don't know which company he is with.
The guy is dodgy and is trying to worm his way out of paying. I have sent him the quotes ($1,500 damage) and a letter of demand. Just talked to him on the phone and he said he's not doing anything for 2 1/2 weeks cos he has no time and money. I said thats not good enough and was arguing with him and he told me not to call him again and said he will correspond with me only by mail.
I have 3rd party insurance and called them and they said send him a letter of demand asking for his insurance company. I will do it monday but I am afraid he will ignore it. Is there any way of finding out who he is insured with? Will an insurance company give these details to me?

Feel like going round to his house and beating the f*ck out of him, but I guess I gotta do this by the book. Anyone been in a similar situation? Got some advice for me? (would be much appreciated)

yup, ring up the police and they'll give him a visit.

blue uniforms usually give a good result.

yep tell the police,
same thing happened to my mate in his vl sludgadore, other person didnt have insurance though but police made him cough up with the cash,

Mate,

Did you get the most important details? These are the vehicle rego number (plates) and his drivers license number? That way all you have to do is make a normal insurance claim and you insurance company will chase it up, you dont have to raise a sweat.

I also agree..take it to the police.

But dont only call them..go into the station and fill out an accident
report..u have to explain the whole accident and draw a picture.
And this info will be accessed by insurance companies.

This should possibly work to your advantage since the other guy is "too busy" to do the same.

I had a simmilar accident but on the road and the other guy thought he wasnt in the wrong...but thats another story.

Another unfortunate hassle you will have to look forward to is the waiting period to be paid out by insurance..from memory they took around 3 months before i got my excess back but i'm insured.

Any way all the best in getting the other guy to cough up.

Sorry MPC, but ringing the police won't do a thing and as you know, with only third party insurance, you're insurance company will not chase it up. I know, I had the same deal with my first car.

You need to send him a letter of demand, and if you don't hear anything within two weeks, send him another one stating that you will take court action if you do nothing.

If they still don't reply, I'm afraid you'll have to take him to court.

I took the guy to court and came out with just under $3000.
Not bad considering the car was worth $2000.

Sorry, but if the guy doesn't want to pay, court action is the only option.

So who's right in this matter mr_nismo or the multiples of people saying go to the cops.

At the moment i'm placing my money on going to the cops.

if mr_nismo is talking from experience then i guess he is right. But i guess it wont hurt if you go to the cops first.

If the other guy didn't have any insurance, it may be a different story - the cops may help. But since he does, the cops will probably tell you they have better things to do.

Last time I had an accident, since noone was injured and there was minor damage, the cops said don't even worry about filling in an accident report form, just go to your insurance company. It's just more unnecessary paper work for them.

Thanks for the suggestions guys. I've talked to a lawyer and am sending him a nasty letter of demand. If he doesn't reply in 10 days i'll be starting legal proceedings. Why do people have to make little things so f-in hard....... I'll let u know how it goes.
